Please read these Terms and Conditions ("Terms") carefully before using the SendePaga mobile application ("the App"). By using the App, you agree to be bound by these Terms.
1. Description of Service
SendePaga provides an automation platform that allows users to create on-device rules ("Automations"). These Automations are executed based on local triggers (e.g., Bluetooth, Wi-Fi, battery status).
2. "As Is" and "As Available" Disclaimer
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Midens ("the Developer") makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, or materials included in the App.
Specifically, the Developer does not warrant that:
- The App will meet your specific requirements.
- The App will be uninterrupted, timely, secure, or error-free.
- Automations will fire or execute with 100% reliability.
- The results that may be obtained from the use of the App will be accurate or reliable.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.
This includes, without limitation, damages for:
- Loss of profits, goodwill, use, data, or other intangible losses.
- Any loss or damage resulting from the failure of an Automation to fire, execute, or perform as expected.
- Personal injury or property damage resulting from your use of the App.
- Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
IN NO CASE SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE APP (IF ANY).
4. User Responsibility
You acknowledge and agree that:
- You are solely responsible for the configuration and testing of your Automations.
- SendePaga is NOT designed or intended for use in high-risk environments or for critical life-safety functions (e.g., medical devices, emergency alerts, or critical security systems).
- Environmental factors beyond the App's control (e.g., OS battery optimization, sensor failure, or hardware limitations) may prevent Automations from firing.
5. Third-Party Apps
The App may interact with or launch third-party applications. The Developer is not responsible for the behavior, content, or availability of those third-party applications.
6. Changes to Terms
We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.
