These Terms of Service apply to MiBida ("the App"), published by MIDENS ("we", "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What MiBida is
MiBida is a personal life-logging and self-tracking app. You use it to record events, logs, notes and tags about your own life and look back on them. Everything is stored on your device.
2. Price
MiBida is free. It has no ads and no in-app purchases. We may later offer an optional, voluntary tip. A tip will never unlock features: everything in the App stays available to everyone.
3. No account, your data stays on your device
MiBida has no account and no sign-up. Everything you enter stays on your device. We never receive it and cannot see, recover or restore it. How we handle (or rather, do not handle) your data is described in the Privacy Policy.
4. Backups are your responsibility
Because we hold no copy of your data, you are responsible for your own backups. Use the App's export to save a backup file and keep it somewhere safe.
- Importing a backup replaces all existing data in the App. Data that is not in the imported file is lost.
- If you lose your device, uninstall the App or reset its data without a backup, your data cannot be recovered.
- If you set a password on a backup and forget it, we cannot open the file for you.
5. App lock
You can protect the App with an optional PIN lock. Choose a PIN you will remember. We cannot reset it for you. The lock helps keep casual onlookers out; it does not replace your device's own security.
6. Not medical or health advice
MiBida is for personal reflection only. It is not a medical device and does not give medical, health, psychological or other professional advice. Do not use it to diagnose, treat or monitor any condition. If you have concerns about your health, talk to a qualified professional.
7. Provided "as is"
The App is provided "as is" and "as available". We do our best to make it reliable, but we do not promise that it will be free of errors, work without interruption, or meet every need you have. Reminders depend on your device's operating system and settings and may not always fire.
8. Liability
To the extent permitted by Dutch and EU law, we are not liable for indirect or consequential damage, or for loss of data, arising from your use of or inability to use the App. Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent or gross negligence.
9. Your consumer rights
If you are a consumer in the EU, you keep all rights that mandatory consumer law gives you. These Terms do not affect them.
10. Intellectual property
The MiBida name, logo and software belong to MIDENS. All rights reserved. You may use the App for your own personal, non-commercial purposes. The App includes open-source libraries, which are subject to their own licences.
11. Changes to these Terms
If these Terms change, the new version will be published at this address with a new effective date. Continuing to use the App after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Netherlands. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a dispute before the courts there.
